Terms of Service

These Terms of Service ("Terms") govern your use of VynexCRM, operated by Kyrnich & Co ("we", "us", "our"). By creating an account or using the service, you agree to these Terms.
1. Service Description
VynexCRM is a multi-tenant messaging CRM platform that enables businesses to manage conversations across messaging channels (Telegram, WhatsApp, Messenger, Instagram) alongside sales pipelines, contacts, and contracts.
2. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your credentials
- You must be at least 16 years old to use the service
- You are responsible for all activity under your account
- Notify us immediately of any unauthorized use of your account
3. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Send spam or unsolicited messages through connected channels
- Attempt to access other users' data or workspaces
- Reverse engineer, decompile, or disassemble the service
- Use the service to store or transmit malicious code
- Exceed reasonable usage limits or abuse API access
- Violate any applicable messaging platform's terms of service
4. Data Ownership
- Your Data: You retain all rights to the data you upload, create, or process through VynexCRM. We do not claim ownership of your content.
- Data Processing: We process your data solely to provide the service. See our Privacy Policy for details.
- Data Portability: You may export your data at any time using the built-in export features.
- Data Deletion: Upon account or workspace deletion, we will delete your data within 30 days, except where retention is required by law.
5. Workspace & Multi-Tenancy
- Each workspace is an isolated environment with its own data, users, and configuration
- Workspace owners are data controllers for contact data within their workspace
- Workspace owners are responsible for ensuring they have proper legal basis to process contact data
- We provide tools for consent management, data export, and erasure to support compliance
6. Messaging Channel Integration
- You are responsible for complying with each messaging platform's terms (Telegram, Meta/WhatsApp, etc.)
- We are not responsible for changes to third-party platform APIs or policies
- Channel credentials are encrypted and stored securely
- We do not access your messaging channel data except to provide the service
7. Subscription & Billing
- Pricing is as displayed on our website at the time of purchase
- Subscriptions renew automatically unless cancelled
- We may change pricing with 30 days' notice
- Refunds are available within 14 days of initial purchase if the service has not been substantially used
8. Service Availability
- We aim for 99.9% uptime but do not guarantee it
- Scheduled maintenance will be communicated in advance
- We are not liable for downtime caused by third-party services
9. Limitation of Liability
To the maximum extent permitted by law, VynexCRM and Kyrnich & Co shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Our total liability for any claim arising from the service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
- You may close your account at any time from account settings
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your right to use the service ceases immediately
- We will retain your data for 30 days after termination to allow for data export
11. Governing Law
These Terms are governed by the laws of the European Union and the applicable member state jurisdiction. Any disputes shall be resolved in the competent courts of that jurisdiction.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use of the service after changes constitutes acceptance.
